The article, as part of a broader reflection on the criticism of the right to development and its impact on the modes of legal and political subjectivation of children and adolescents, questions the child's condition as a subject without speech, or a speech conditioned to criteria of maturation, dictated by the adult referential, in a field, moreover, limited to what is said to be pertinent to their manifestation. Guided by the thought of exteriority, we return to the Foucauldian debate on (...) the relation between truth and justice, in light of the monstrous unspeakability of legal and judicial practices and the ubuesco of state power. We will analyze, through the contributions of classic cynicism, supported by Foucault, and Sloterdijk, Nieheus-Pröbsting, the resistant practices - beyond language – available to children and adolescents, and rethink these power struggles in the context of human rights and the possibility of justice, through the thought of Derrida, Rancière, Butler and Foucault. Our text will develop along the following axes of analysis: 1. Contextualizing the Foucaultian debate on truth and justice and the place of the “sayable”; 2. Considering the sayability at the heart of law, childhood and monstrosity; 3. Framing the struggle between ubuesco power and cynic resistance, and 4. Speculating on our notions of “child” and the possibility of justice. (shrink)

This paper proposes an account of neurocognitive activity without leveraging the notion of neural representation. Neural representation is a concept that results from assuming that the properties of the models used in computational cognitive neuroscience must literally exist the system being modelled. Computational models are important tools to test a theory about how the collected data has been generated. While the usefulness of computational models is unquestionable, it does not follow that neurocognitive activity should literally entail the properties construed in (...) the model. While this is an assumption present in computationalist accounts, it is not held across the board in neuroscience. In the last section, the paper offers a dynamical account of neurocognitive activity with Dynamical Causal Modelling that combines dynamical systems theory mathematical formalisms with the theoretical contextualisation provided by Embodied and Enactive Cognitive Science. In the early 1920s, Hans Reichenbach and Kurt Lewin presented two topological accounts of time that appear to be interrelated in more than one respect. Despite their different approaches, their underlying idea is that time order is derived from specific structural properties of the world. In both works, moreover, the notion of genidentity--i.e., identity through or over time--plays a crucial role. Although it is well known that Reichenbach borrowed this notion from Kurt Lewin, not much has been written about their (...) relationship, nor about the way Lewin implemented this notion in his own work in order to ground his topology. This paper examines these two early versions of the topology of time, and follows the extent of Lewin’s influence on Reichenbach’s proposal. (shrink)

In his Scientific Representation (2008), van Fraassen argues that measuring is a form of representation. In fact, every measurement pinpoints its target in accordance with specific operational rules within an already-constructed theoretical space, in which certain conceptual interconnections can be represented. Reichenbach’s 1920 account of coordination is particularly interesting in this connection. Even though recent reassessments of this account do not do full justice to some important elements lying behind it, they do have the merit of focusing on a different (...) aspect of his early work that traditional interpretations of relativized a priori principles have unfortunately neglected in favour of a more “structural” role for coordination. In Reichenbach’s early work, however, the idea of coordination was employed not only to indicate theory-specific fundamental principles such as the ones suggested in the literature on conventional principles in science, but also to refer to more “basic” assumptions. In Reichenbach, these principles are preconditions both of the individuation of physical magnitudes and of their measurement, and, as such, they are necessary to approach the world in the first instance. This paper aims to reassess Reichenbach’s approach to coordination and to the representation of physical quantities in light of recent literature on measurement and scientific representation. In the Eudemian Ethics Aristotle states that human beings are starting points of things that could be otherwise and that the eph’hemin are this kind of things. Famously, in the Nicomachean Ethics Aristotle endorses the thesis of habits’ unidirectionality, according to which the agent who already possesses moral habits, hexeis, will perform only actions consistent with the habits she possesses. Despite this apparent inconsistency, I aim to show that the two texts can be harmonized and that the Eudemian Ethics can (...) actually provide a theoretical background for habits’ unidirectionality. The aim of this paper is twofold: (1) to assess whether the construct of neural representations plays an explanatory role under the variational free-energy principle and its corollary process theory, active inference; and (2) if so, to assess which philosophical stance - in relation to the ontological and epistemological status of representations - is most appropriate. We focus on non-realist (deflationary and fictionalist-instrumentalist) approaches. We consider a deflationary account of mental representation, according to which the explanatorily relevant contents of neural (...) representations are mathematical, rather than cognitive, and a fictionalist or instrumentalist account, according to which representations are scientifically useful fictions that serve explanatory (and other) aims. After reviewing the free-energy principle and active inference, we argue that the model of adaptive phenotypes under the free-energy principle can be used to furnish a formal semantics, enabling us to assign semantic content to specific phenotypic states (the internal states of a Markovian system that exists far from equilibrium). We propose a modified fictionalist account: an organism-centered fictionalism or instrumentalism. We argue that, under the free-energy principle, pursuing even a deflationary account of the content of neural representations licenses the appeal to the kind of semantic content involved in the aboutness or intentionality of cognitive systems; our position is thus coherent with, but rests on distinct assumptions from, the realist position. We argue that the free-energy principle thereby explains the aboutness or intentionality in living systems and hence their capacity to parse their sensory stream using an ontology or set of semantic factors. In 2000, Rüdiger Thiele [1] found in a notebook of David Hilbert, kept in Hilbert's Nachlass at the University of Göttingen, a small note concerning a 24th problem. As Hilbert wrote, he had considered including this problem in his famous problem list for the International Congress of Mathematicians in Paris in 1900.

In recent years, Reichenbach's 1920 conception of the principles of coordination has attracted increased attention after Michael Friedman's attempt to revive Reichenbach's idea of a "relativized a priori". This paper follows the origin and development of this idea in the framework of Reichenbach's distinction between the axioms of coordination and the axioms of connection. It suggests a further differentiation among the coordinating axioms and accordingly proposes a different account of Reichenbach's "relativized a priori".

This highly multidisciplinary collection discusses an increasingly important topic among scholars in science and technology studies: objectivity in science. It features eleven essays on scientific objectivity from a variety of perspectives, including philosophy of science, history of science, and feminist philosophy. Topics addressed in the book include the nature and value of scientific objectivity, the history of objectivity, and objectivity in scientific journals and communities. Taken individually, the essays supply new methodological tools for theorizing what is valuable in the pursuit (...) of objective knowledge and for investigating its history. The essays offer many starting points, while suggesting new avenues of research. Taken collectively, the essays exemplify the very virtues of objectivity that they theorize—in reading them together, the reader can sense various anxieties about the dangerously subjective in our age and locate commonalities of concern as well as differences of approach. Admiration and adoration have been considered as emotions with the power to change people, yet our knowledge of the specific nature and function of these emotions is quite limited. From an interdisciplinary perspective, we present a prototype approach to admiration and what has variously been labelled adoration, worship, or reverence. Both admiration and adoration contribute to the formation of personal and collective ideals, values, and identities, but their workings differ. We offer a detailed theoretical account of commonalities and differences in (...) the appraisal patterns and action tendencies associated with the two emotions. This analysis reveals that admiration motivates the internalisation and emulation of ideals embodied by an outstanding role model. Adoration motivates adherence to the teachings and expectations of a meaning maker and benefactor perceived as superhuman or sacred. Thus, the primary function of admiration is to promote individual learning and change, whereas adoration primarily serves to bind communities together. (shrink)

The Operation Lava Jato, initiated in 2014 by the Ministry of Finance and carried out by the Brazilian Government Agency for Law Enforcement and Prosecution of Crimes, brought to light the unethical practices of several national contractors, despite their declared commitment to social responsibility and ethical management—a corporate conduct epitomized in the popular saying: “Do what I say; don’t do what I do”. In this chapter, we analyze such disconnection between discourse and practice vis-a-vis the literature on leadership and business (...) ethics, Brazilian culture and historical analyses of the Brazilian contractors industry. We examine the official discourse of a Brazilian contractor, as observed in documents retrieved from websites and statements to the press, and its practices, as depicted in the media and documented in testimonies already conducted by the federal courts and attached to the original case-files. Specifically, we aim to contribute to the reflection on management and ethics in Brazil by identifying and discussing the factors that seem to have promoted such disconnection, including aspects of national culture and the institutional environment, together with organizational culture and leadership. This paper aims to study the concept of “fact of reason”, with the assistance Beck as North on the stage of transcendental philosophy, more specifically its basic Kantian approach, continuing to explore the potential of the above since the contributions of Guido de Almeida and Loparic.

In Eth. Nic. V 8, Aristotle provides a classification of damages an agent may do, establishing degrees of culpability. In doing so, Aristotle recalls what he said about voluntary and involuntary actions in the preceding books about voluntary and involuntary actions. In this paper, I defend the thesis according to which the Eudemian account on voluntariness is consistent with the classification of damages Aristotle provides in Eth. Nic. V 8, arguing that one of Aristotle’s concerns in dealing with voluntariness is (...) the legal practices of his time, which we can regard as strongly linked to his discussion on moral responsibility. Thereby, I challenge David Charles’ view that the account of voluntariness featured in the book on justice differs both from the Nicomachean account and the Eudemian one. (shrink)

In this article the author maintains that complexity theory relies on reductionist assumptions, showing itself not to be completely convincing in dealing with the issue of novelty. First, an outline of Mark C. Taylor's The Moment of Complexity is presented as an exemplary case, particularly for his attempt to import complexity theory into the social sciences. Then, the connection between complexity theory and evolutionism is considered, arguing that this connection prevents complexity theory from giving a convincing account of the emergence (...) of novelty. A provisional conclusion is offered by arguing that novelty should be conceived as arising from a "widening" of reduction at the individual level. (shrink)

O objetivo do estudo é analisar a série De onde vem? , a qual introduz o conhecimento científico na infância, identificando aspectos que justifiquem o seu emprego como um recurso pedagógico adequado para a introdução de conceitos de Ciência de forma lúdica e dinâmica na infância. Os resultados apresentam aspectos gerais dos episódios da Série, além da descrição estrutural dos episódios de forma generalizada de acordo com as categorias sugeridas por Gomes (2008). A Série introduz conceitos científicos, presentes no cotidiano, (...) por meio de uma linguagem adequada à compreensão infantil, tornando, assim, este material uma importante alternativa de apoio ao professor do Ensino Fundamental para a introdução da ciência na infância. Every cartilage and bone in the vertebrate skeleton has a precise shape and position. The head skeleton develops in the embryo from the neural crest, which emigrates from the neural ectoderm and forms the skull and pharyngeal arches. Recent genetic data from mice and zebrafish suggest that cells in the pharyngeal segments are specified by positional information in at least two dimensions, Hox genes along the anterior‐posterior axis and other homeobox genes along the dorsal‐ventral axis within a segment. Many zebrafish (...) and human mutant phenotypes indicate that additional genes are required for the development of groups of adjacent pharyngeal arches and for patterning along the mediolateral axis of the skull. The complementary genetic approaches in humans, mice and fish reveal networks of genes that specify the complex morphology of the head skeleton along a relatively simple set of coordinates. (shrink)

Synaptophysin (Syp) was the first synaptic vesicle (SV) protein to be cloned. Since its discovery in 1985, it has been used by us and by many laboratories around the world as an invaluable marker to study the distribution of synapses in the brain and to uncover the basic features of the life cycle of SVs. Although single gene ablation of Syp does not lead to an overt phenotype, a large body of experimental data both in vitro and in vivo indicate (...) that Syp (alone or in association with homologous proteins) is involved in multiple, important aspects of SV exo‐endocytosis, including regulation of SNARE assembly into the fusion core complex, formation of the fusion pore initiating neurotransmitter release, activation of SV endocytosis and SV biogenesis. In this article, we summarise the main results of the studies on Syp carried out by our and other laboratories, and explain why we believe that Syp plays a major role in SV trafficking. This paper presents an intuitive explanation about why and how Rawlsian Theory of Justice (Rawls in A theory of justice, Harvard University Press, Harvard, 1971) provides the foundations to a solution for algorithmic bias. The contribution of the paper is to discuss and show why Rawlsian ideas in their original form (e.g. the veil of ignorance, original position, and allowing inequalities that serve the worst-off) are relevant to operationalize fairness for algorithmic decision making. The paper also explains how this leads (...) to a specific MinMaxfairness solution, which addresses the basic challenges of algorithmic justice. We combine substantive elements of Rawlsian perspective with an intuitive explanation in order to provide accessible and practical insights. The goal is to propose and motivate why and how the MinMaxfairness solution derived from Rawlsian principles overcomes some of the current challenges for algorithmic bias and highlight the benefits provided when compared to other approaches. The paper presents and discusses the solution by building a bridge between the qualitative theoretical aspects and the quantitative technical approach. (shrink)

In recent years, many researchers engaged in diverse areas and approaches of “cultural-historical activity theory” (CHAT) realized an increasing international interest in Lev S. Vygotsky’s, A. N. Leont’ev’s, and A. Luria’s work and its continuations. Not so long ago, Yrjö Engeström noted that the activity approach was still “the best-held secret of academia” (p. 64) and highlighted the “impressive dimension of theorizing behind” it. Certainly, this remark reflects a time when CHAT was off the beaten tracks. But if this situation (...) begins to change today, in which direction will CHAT be heading? Will it continue to be one of those projects “unique for its practical, political, and civic engagement” committed “to ideals of social justice, equality, and social change” as it was in the beginning (Stetsenko & Arievitch, 2004, p. 58)? Although a positive future of CHAT seems to lie ahead, we consider in this article some of the problematics that may challenge all those who want to pass the “impressive dimensions of theorizing” from “insider” circles to a larger audience and from one generation to another as well as encourage newcomers to become part of this tradition through critical engagement in its theory and practice. A key to these engagements, we suggest, is not only the comprehensive empirical and philosophical basis, but also the role of dialectics as both topic and method. Therefore, the challenge for newcomers (as well as for “old-timers”) to take on the tradition of CHAT is not a small one indeed. We assume that a major reason for the increasing interest in CHAT lies in its potential to provide a non-reductionist approach to human development, which is due to its affinity to dialectics; however, the close interrelation to a tradition that reaches back to the theories of Georg W.F. Hegel and Karl Marx, among others, is not the easiest to master. In consideration of these difficulties, the purpose of this article is to investigate how contemporary approaches within CHAT can continue to provide a dialectical framework to preserve and renew the critical intention of this tradition, and how we run the risk of losing this sting. Thereby, we sensitize researchers to the problem of developing a cultural-historical approach within a historical situation that confronts us with new, unanswered questions. In this light, we also problematize the use of scientific language, for it may lead us to speak and argue un-dialectically when in fact we intend or ought to think dialectically. This article seeks to convey insights and arguments of how we can relate our theoretical approaches to a tradition of dialectical thinking and in what ways this is paramount for a critical engagement in theory and practice. In the first part, we therefore discuss not only some major theorems in Hegel’s and Marx’s work but also, and above all, Vygotsky’s way of developing the cultural-historical approach of psychology. Second, we argue that the contemporary, widely known version of CHAT, related to Yrjö Engeström’s theoretical and empirical work, neglects different aspects of dialectical thinking and consequently narrows its potential to a socio-critical approach to societal practice and human development. A crucial question of this scrutiny will be the notion of contradictions and how development is supposed to be achieved. In general, our intention is not only to clarify the role of dialectics as a method for activity theory but also to problematize the role of the subjects of research in CHAT and to confront ourselves with the problems of practicing and developing a critical science in face of a complex and challenging societal world. This paper is the result of my participation in a discussion event of Problema. Anuario de filosofía y teoría del derecho entitled “The Construction of Precedent in Civil Law: Debates, Concepts and Challenges”. Several colleagues with a vast knowledge on the subject of judicial precedent participated in this seminar, which also delved into the widely debated aspects of judicial precedent focused on the case of Chile. The entire discussion aimed at proposing solutions, as well as shedding some light on some (...) of its important aspects.Starting from such transcendental concepts as, rationality and argumentative use, it is possible to find certain problems arising from the improper use of the above concepts, which in turn leads us to stare decisis, a term that if used incorrectly may result in an act against the internal independence of judges. When someone masters a skill, their performance looks to us like second nature: it looks as if their actions are smoothly performed without explicit, knowledge-driven, online monitoring of their performance. Contemporary computational models in motor control theory, however, are instructionist: that is, they cast skillful performance as a knowledge-driven process. Optimal motor control theory, as representative par excellence of such approaches, casts skillful performance as an instruction, instantiated in the brain, that needs to be executed—a motor command. This paper aims (...) to show the limitations of such instructionist approaches to skillful performance. We specifically address the question of whether the assumption of control-theoretic models is warranted. The first section of this paper examines the instructionist assumption, according to which skillful performance consists of the execution of theoretical instructions harnessed in motor representations. The second and third sections characterize the implementation of motor representations as motor commands, with a special focus on formulations from OMCT. The final sections of this paper examine predictive coding and active inference—behavioral modeling frameworks that descend, but are distinct, from OMCT—and argue that the instructionist, control-theoretic assumptions are ill-motivated in light of new developments in active inference. This aim of this paper is two-fold: it critically analyses and rejects accounts blending active inference as theory of mind and enactivism; and it advances an enactivist-dynamic understanding of social cognition that is compatible with active inference. While some social cognition theories seemingly take an enactive perspective on social cognition, they explain it as the attribution of mental states to other people, by assuming representational structures, in line with the classic Theory of Mind. Holding both enactivism and ToM, we argue, (...) entails contradiction and confusion due to two ToM assumptions widely known to be rejected by enactivism: that social cognition reduces to mental representation and social cognition is a hardwired contentful ‘toolkit’ or ‘starter pack’ that fuels the model-like theorising supposed in. The paper offers a positive alternative, one that avoids contradictions or confusion. After rejecting ToM-inspired theories of social cognition and clarifying the profile of social cognition under enactivism, that is without assumptions and, the last section advances an enactivist-dynamic model of cognition as dynamic, real-time, fluid, contextual social action, where we use the formalisms of dynamical systems theory to explain the origins of socio-cognitive novelty in developmental change and active inference as a tool to demonstrate social understanding as generalised synchronisation.
